Homeowner acknowledges that the success of the Property as a short-term vacation rental is a material aspect of its Agreement with KeyLink, and such success depends on compliance with many different rules and requirements.

General Covenants.

Homeowner covenants to fully perform, adhere to, comply with, and/or take full responsibility for the below listed items.

  1. All building and safety codes applicable to the Property.
  2. All licensing and taxing requirements applicable to the Property and not otherwise obtained or performed by KeyLink.
  3. All short-term vacation rental laws, ordinances, rules, and policies promulgated by the local government having jurisdiction over the Property, and all municipal laws and ordinances, state laws, national laws, and other laws, rules, and regulations pertaining to the Property.
  4. All homeowners’ association and other neighborhood and private agreements, covenants, easements, rules, and/or policies with respect to the Property and the short-term vacation rental thereof.
  5. All property taxes, special assessments, mill levy’s, and the like, associated with the Property.
  6. Performing and warrantying all Homeowner obligations under this Agreement.
  7. All laws and policies regarding intellectual property rights, privacy, likeness and publicity, including without limitation, use of photographs of others, and use of others’ personal contact or credit/debit or account information, without their lawfully written permission. No harassing or stalking any other Homeowner and/or Guest, no impersonating any person or entity, no falsifying or otherwise misrepresenting yourself or your affiliation with any person or entity, and no use of KeyLink Services in connection with the distribution of unsolicited commercial email ("spam") or advertisements.
  8. No use of KeyLink Services for short-term vacation rental bookings and then completing the transaction outside of KeyLink’s system with the result of circumventing the obligation to pay for KeyLink Services.

Covenants Regarding Sale of Property.

Homeowner agrees to provide KeyLink at least 60-days advance written notice before listing the Property for sale.

Covenants Regarding Payment of Service Providers.

Homeowner agrees to have all estimates, bids, bills, and invoices of third-party service providers, venders, and contractors made directly in Homeowner’s name, to have same sent directly to Homeowner’s primary mailing address, and to pay same promptly and directly.

Covenants Regarding Property Requirements, Maintenance, Safety.

  1. Supplies and Furnishings, Damages. Homeowner acknowledges that Guests book the Property with the expectation that it is fully furnished and equipped with good quality furnishings, cabinetry, electrical and plumbing systems, good and working appliances, linens, towels, bedding, kitchen utensils, kitchen supplies, dish ware, glassware, silverware, batteries, light bulbs, and the like. Homeowner agrees to furnish all such items, and promptly replace such items, at its expense. Homeowner acknowledges the Wear and Tear & Damages Policy is available on www.keylinkvr.com (as amended from time to time), that it contains additional policies, terms, and conditions, and agrees to same.
  1. Inspection; Maintenance, Upkeep, Repair by Homeowner. Homeowner acknowledges it is responsible for maintaining safe and habitable conditions at the Property, and understands that as a prudent homeowner, it should get an annual inspection of the Property with a licensed home inspector, to ensure the Property and its systems (such as roof, foundation, electrical, plumbing, etc.) are in good and safe condition. Homeowner acknowledges and agrees that the success of the Property as a vacation rental depends on the appearance and upkeep of the Property. Homeowner agrees, at its sole expense, to maintain and regularly inspect the Property (or retain a service provider for such), including without limitation, the performance, contracting, and oversight of routine and seasonal items (snow-removal, sprinkler-system, landscaping, heat-tape, gutters, back flow, decks, etc.), all repairs and upkeep, and all other ordinary responsibilities of a prudent and diligent homeowner.
  2. Requirements, Safety. Homeowner agrees to maintain safe and habitable conditions at the Property and agrees to promptly repair and replace any conditions so as to restore the Property to the same or better condition. Homeowner agrees to maintain a sufficient number of carbon monoxide and smoke detectors in good working order in the Property and will cause the batteries to be checked and replaced on a regularly scheduled basis to ensure functionality. If Keylink reasonably determines an unsafe condition exists at the Property, whether caused by the Property’s physical conditions, contentious or harassing neighbors, or other failure to meet Property requirements, Keylink may terminate the Agreement, and Homeowner agrees to reimburse KeyLink as specified in the Agreement and KeyLink policies.

General. All definitions, terms, conditions, and agreements contained in KeyLink’s policies and the Agreement between Keylink and Homeowner are incorporated and apply to this Policy.
